Electronic Agreement

This Agreement is an electronic contract that sets out the legally binding terms of your use of the Websites and Services. By accessing and using the Websites or scheduling DNA testing services, you accept this Agreement and agree to its terms, conditions, and notices. MobileDNAHub reserves the right to modify this Agreement at any time, with changes becoming effective upon posting to the Websites.

1. Access and Retention

In order to access and retain this Agreement, you must have access to the internet and all equipment necessary to make such connections, including a computer or mobile device. You may retain a copy of this Agreement by saving it to any word processing program or printing it for your records.

2. Use of the Services

MobileDNAHub offers various DNA testing services, including:

  • Legal paternity tests.

  • Non-invasive prenatal paternity tests.

  • Family relationship tests.

  • Early gender detection.

  • Immigration-related DNA sample collection (Note: Clients must contact certified laboratories directly for immigration DNA testing. MobileDNAHub provides only the collection service).

By booking DNA testing services, you agree to provide accurate and complete information, including government-issued IDs and birth certificates for minors. You also agree to ensure all participants in the DNA test are legally consenting adults, or legally represented by a parent or guardian.

3. Commercial Use of Service

If you are using the Services on behalf of a company or organization (a “Subscribing Entity”), you represent and warrant that:

  • You are an authorized representative of the Subscribing Entity and have the authority to bind the Subscribing Entity to these Terms of Service.

  • You have read and understand these Terms of Service.

  • You agree to these Terms on behalf of the Subscribing Entity.

4. Payments and Fees

  • Payment: Full payment is required before any DNA testing services are conducted. Payment plans may be available through third-party financing partners.

  • No Refund Policy: There are absolutely no refunds once a test has been booked and paid for, regardless of the reason for cancellation or the progress of the service.

  • Additional Fees: Additional fees may apply for expedited test results, locations more than 20 miles from the collection point, same-day services, or after-hours appointments.

5. Sample Collection and Testing Process

  • Sample Collection: DNA samples are primarily collected using a cheek swab at your chosen location by MobileDNAHub professionals. For legal DNA tests, participants must provide a government-issued photo ID, and birth certificates are required for minors.

    • Prenatal Testing: In the case of non-invasive prenatal paternity (NIPP) tests, a blood sample may be drawn from the mother. This will be performed by a certified healthcare professional, ensuring a safe and accurate collection process.

  • Laboratory Testing: All collected samples are sent to our partner certified laboratories for analysis. The laboratories adhere to strict legal and industry standards to ensure accuracy and reliability in DNA test results.

  • Immigration Testing: Clients are responsible for contacting a certified laboratory directly for immigration DNA testing before booking with MobileDNAHub for the collection service.

6. Unauthorized Use of Services

You agree not to use MobileDNAHub for any illegal or unauthorized purposes, including but not limited to:

  • Collecting or attempting to collect personal data from other users without consent.

  • Using automated scripts, spiders, or bots to access the Websites.

  • Circumventing security measures or attempting to gain unauthorized access to the Services or networks.

MobileDNAHub may investigate illegal or unauthorized activities and take legal action, including terminating your account and cooperation with law enforcement authorities.

7. Account Security

You are responsible for maintaining the confidentiality of your username and password. You are also responsible for all activities that occur under your account. You agree to notify MobileDNAHub immediately of any unauthorized access to your account or breach of security.

8. Content and Proprietary Rights

MobileDNAHub retains all proprietary rights in the Services, including the DNA testing process and any content posted on the Websites. You may not modify, distribute, reproduce, or republish any part of the Services without prior written permission.

9. Limitations of Liability

MobileDNAHub is not liable for:

  • Delays caused by partner laboratories or third-party services.

  • Issues related to incorrect or incomplete information provided by clients.

  • Unauthorized use of DNA test results by third parties.

  • Any indirect, incidental, or consequential damages resulting from the use of the Websites or Services.

10. Dispute Resolution

In the event of a dispute, you agree to attempt to resolve the matter informally with MobileDNAHub first. If the matter cannot be resolved, you agree to submit the dispute to binding arbitration under the rules of the American Arbitration Association (AAA).

11. Governing Law

These Terms of Service are governed by the laws of the United States and the State of Massachusetts, without regard to its conflict of law provisions.

12. Changes to the Terms

We reserve the right to update or modify these Terms of Service at any time. Continued use of the Websites and Services following changes constitutes acceptance of the revised Terms.
